These Terms of Service (“Terms”) govern your access to and use of the Éclat Living website, online store, products, content, features, and related services (collectively, the “Services”).
The Services are operated by Éclat Living, doing business as Éclat Living (“Éclat Living,” “we,” “us,” or “our”).
By visiting our website, creating an account, placing an order, submitting content, or otherwise using the Services, you agree to these Terms and acknowledge our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms excludes, restricts, or modifies any warranty, guarantee, remedy, or consumer right that cannot lawfully be excluded, restricted, or modified.
1. Eligibility and authority
You must be at least the age of majority in your state, province, country, or other jurisdiction of residence to make a purchase through the Services.
If you are under the applicable age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian.
If you use the Services on behalf of a company, organization, or another person, you represent that you have authority to bind that party to these Terms.
2. Changes to these Terms
We may update these Terms periodically to reflect changes to our Services, business practices, technologies, legal obligations, or operational requirements.
The current version will be published on this page with an updated “Last updated” date. Unless otherwise required by law, changes become effective when published.
Your continued use of the Services after revised Terms become effective means that you accept the revised Terms. Changes will not apply retroactively where doing so would be prohibited by applicable law.
3. Online store terms
You may use the Services only for lawful personal or household purposes unless we expressly authorize another use in writing.
You must not use the Services or our products:

We may restrict or terminate access to the Services when we reasonably believe these Terms have been violated.
4. Customer accounts
Certain features may require a customer account.
You agree to provide accurate, current, and complete information and to update that information when necessary. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
You must notify us promptly at eclat@eclatliving.store if you believe your account has been accessed or used without authorization.
We may suspend or close an account when reasonably necessary to prevent fraud, address a security risk, comply with law, investigate a violation of these Terms, or protect customers and the Services.
5. Product information
We make reasonable efforts to describe and display our products accurately. However, colors, finishes, textures, patterns, proportions, and other visual details may appear differently depending on screen settings, lighting, photography, manufacturing processes, and the characteristics of natural or handmade materials.
Measurements are approximate unless expressly stated otherwise. Minor differences in dimensions, color, glaze, grain, pattern placement, texture, or finish may occur and do not necessarily constitute a defect.
Product packaging, labeling, materials, features, suppliers, and specifications may change when reasonably necessary, provided that the substitute does not materially reduce the product’s essential characteristics or quality.
You are responsible for reviewing product descriptions, dimensions, materials, care instructions, compatibility information, and installation requirements before purchasing.
Products must be used only for their intended purposes and in accordance with all included safety warnings, assembly instructions, care instructions, and manufacturer guidance.
6. Product availability
All products are subject to availability.
Placing an item in your shopping cart does not reserve the item. We may limit quantities, discontinue products, restrict sales by person or location, or cancel unavailable items.
If a product becomes unavailable after you place an order, we may:

Cancel the unavailable item and issue an appropriate refund;

Contact you to offer a reasonable substitute; or

Delay fulfillment with your agreement.
We will not substitute a materially different product without your approval.
7. Prices, currencies, and taxes
Prices may change without notice, but a price change will not ordinarily affect an order we have already accepted.
Prices are displayed in the currency selected or shown on the website. Currency-conversion amounts may be estimates and may differ from the amount charged by your bank, card issuer, or payment provider.
Applicable taxes, shipping charges, duties, customs charges, and other fees will be displayed or disclosed where required before the order is completed.
You are responsible for reviewing the complete order total before submitting payment.
If a pricing, discount, product-description, or calculation error occurs, we may correct the error and contact you for instructions. Where permitted by law, we may cancel an affected order and issue a full refund if the correct information was not accepted before fulfillment.
8. Orders and order acceptance
Submitting an order is an offer to purchase the selected products under these Terms.
An automated order-confirmation email acknowledges that we received the order. It does not necessarily mean the order has been finally accepted.
To the extent permitted by applicable law, an order is accepted when we:

Send a shipping confirmation;

Confirm that fulfillment has begun; or

Otherwise expressly confirm acceptance.
We reserve the right to refuse, limit, hold, or cancel an order for legitimate and lawful reasons, including:

Suspected fraud or unauthorized payment activity;

Incorrect or incomplete billing or shipping information;

Product, pricing, or inventory errors;

Product unavailability;
-
Delivery or geographic restrictions;

Violation of these Terms or another store policy;

Unusually large quantities or suspected unauthorized resale;

Applicable sanctions, export controls, or legal restrictions; or
-
Circumstances that make fulfillment unsafe, unlawful, or commercially impracticable.
If we cancel an order after payment has been captured, we will issue an appropriate refund to the original payment method.
We may request additional information reasonably necessary to verify an order. Failure to provide requested verification may result in delay or cancellation.
9. Billing and payment
You agree to provide accurate, current, and complete billing and payment information.
By submitting payment information, you represent that:

The payment transaction is authorized; and

You authorize the applicable payment provider to charge the order total.
Payments are processed by Shopify and the payment providers made available during checkout. Payment providers may apply their own terms, privacy policies, verification procedures, and security requirements.
We do not guarantee that every payment method will be available for every order, customer, currency, or location.
If a payment is declined, reversed, disputed, identified as unauthorized, or otherwise unsuccessful, we may suspend fulfillment or cancel the order.
10. Promotions, discounts, and gift cards
Promotions and discount codes are subject to any conditions stated with the offer.
Unless expressly stated otherwise:

Promotions cannot be combined;

Discounts cannot be applied after an order has been placed;

Offers have no cash value;
-
Offers may be limited by customer, product, quantity, location, or time;

Discounts apply only to eligible merchandise;

Shipping, taxes, duties, and other fees are excluded; and
-
Promotional offers may be modified or ended before an order is submitted.
We may cancel or adjust a promotion when reasonably necessary to address fraud, misuse, technical errors, or an obvious pricing mistake.
Gift cards, if offered, are governed by any terms disclosed when purchased and by applicable law. Gift cards are not redeemable for cash except where required by law.
11. Shipping, fulfillment, and delivery
Orders may be processed or fulfilled by Éclat Living, suppliers, manufacturers, warehouses, logistics providers, or other fulfillment partners.
Products within the same order may be shipped separately and may arrive at different times or in different packages.
Shipping and delivery estimates are provided in our Shipping Policy and during checkout where applicable. Unless we expressly guarantee a delivery date, delivery dates are estimates rather than guarantees.
Delays may occur because of:

Carrier disruptions;

Severe weather or natural events;

Customs inspections;
-
Peak-season demand;
-
Supplier or warehouse delays;
-
Address problems;
-
Labor disruptions;
-
Transportation interruptions; or
-
Other circumstances outside our reasonable control.
We will provide available tracking or delivery updates when reasonably possible.
You are responsible for providing an accurate, complete, and accessible delivery address. Additional charges caused by an incorrect address, refused delivery, failed delivery attempts, or an unclaimed package may be deducted from a refund or charged before reshipment where permitted by law.
Title to and risk of loss for products pass as provided by applicable law. Nothing in these Terms shifts to you a risk that applicable consumer law requires us to retain until delivery.
International orders may be subject to customs processing, import taxes, duties, brokerage charges, or other government fees. Responsibility for these charges will be disclosed in accordance with applicable law and our Shipping Policy.
12. Returns, refunds, exchanges, and cancellations
Returns, refunds, exchanges, damaged-item claims, order cancellations, and related procedures are governed by our Return and Refund Policy.
You must obtain return authorization before sending a product back. Do not return a product to the address shown on its original shipping package unless we specifically instruct you to do so.
Nothing in our Return and Refund Policy or these Terms limits any mandatory cancellation, return, warranty, or refund rights provided by applicable consumer law.
13. Damaged, defective, or incorrect products
You should inspect products promptly after delivery.
If a product arrives damaged, defective, incomplete, or materially different from what you ordered, contact eclat@eclatliving.store and provide:

A description of the problem;

Photographs or video of the item;
-
Photographs of the packaging and shipping label; and
-
Any other information reasonably needed to investigate the issue.
Keep the item, packaging, labels, components, and protective materials until we confirm that they are no longer needed.
Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement parts, replacement, a price adjustment, a partial refund, or a full refund.
14. Manufacturer information and product warranties
Certain products may include warranties supplied by their manufacturer. Any manufacturer warranty is governed by the terms provided with that product.
We do not make an additional written product warranty unless one is expressly stated on the applicable product page or provided to you in writing.
This section does not exclude or limit any implied warranty, statutory guarantee, product-conformity right, or other consumer protection that cannot lawfully be excluded or limited.
15. Personal information and privacy
Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy.
Because our store is hosted by Shopify, Shopify and associated service providers may process information needed to operate the website, checkout, payments, fraud prevention, analytics, customer accounts, and other store functionality.
By using the Services, you acknowledge that information may be processed by us and our service providers as described in the Privacy Policy and as permitted by applicable law.
16. Customer communications
By providing an email address, telephone number, or other contact information, you agree that we may contact you about:

Shipping and delivery;

Returns, refunds, or customer-service matters;

Account or security issues;

Product safety or recall information;

Changes affecting the Services; and

Transactional communications are not marketing messages and may continue even if you unsubscribe from promotional communications.
Marketing communications will be sent only as permitted by applicable law. You may unsubscribe from promotional emails by using the unsubscribe link included in the message.
17. Reviews, photographs, and other customer content
You may be able to submit reviews, comments, photographs, testimonials, questions, feedback, or other content (“Customer Content”).
You retain ownership of your Customer Content. By submitting it to us, you grant Éclat Living a non-exclusive, worldwide, royalty-free license to host, reproduce, format, publish, display, and use the content in connection with operating, improving, and promoting the Services and products.
This license continues for as long as the content remains published or is reasonably required for materials created before a removal request. Where applicable, you may contact us to request that Customer Content be removed from future use.
You represent that Customer Content:

Is truthful and based on your genuine experience;

Is not knowingly false or misleading;

Does not infringe another person’s rights;
-
Does not reveal another person’s private information without permission;
-
Is not unlawful, threatening, harassing, obscene, discriminatory, or abusive;

Does not contain malicious code, spam, or unauthorized advertising; and
-
Complies with applicable law.
We may moderate, refuse, edit, or remove Customer Content for legitimate reasons, including violations of these Terms. We are not required to publish every submission.
Any material edit that changes the substantive meaning of a customer review will be identified or handled in accordance with applicable law.
18. Intellectual property
The Services and their contents—including text, graphics, photographs, product arrangements, designs, logos, trademarks, videos, software, page layouts, and other materials—are owned by or licensed to Éclat Living and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal shopping purposes.
You may not, without prior written permission:

Copy, reproduce, republish, distribute, sell, license, or commercially exploit our content;

Remove copyright, trademark, or proprietary notices;

Use our name, branding, images, or content in a way that suggests endorsement;

Create derivative works from protected content;

Scrape, mine, or systematically extract store data; or
-
Use protected content to train or develop an artificial-intelligence or machine-learning system.
Product names, company names, and trademarks belonging to third parties remain the property of their respective owners.
19. Copyright and intellectual-property complaints
If you believe content on the Services infringes your copyright, trademark, or another intellectual-property right, contact eclat@eclatliving.store with:

An explanation of your rights and the claimed infringement;

We may remove or restrict access to content while reviewing a properly supported complaint.
20. Third-party tools, links, and services
The Services may contain links to or integrations with third-party websites, applications, payment services, social-media platforms, tracking services, or other tools.
We do not control third-party services and are not responsible for their availability, content, privacy practices, security, or separate transactions.
Your use of a third-party service is governed by that provider’s terms and privacy policy. Review those terms before providing information or completing a transaction.
The presence of a third-party link or integration does not necessarily mean that Éclat Living endorses or guarantees that third party.
21. Errors and interruptions
We make reasonable efforts to maintain accurate and available Services. However, the Services may occasionally contain errors, omissions, interrupted features, outdated information, or technical problems.
We may correct errors, update information, suspend functionality, or cancel an affected order where permitted by law.
We are not obligated to update every historical statement or archived item unless applicable law requires otherwise.
22. Website disclaimer
To the maximum extent permitted by law, the website and its general content are provided on an “as available” basis.
We do not guarantee that:

Website access will always be uninterrupted or error-free;

Every feature will always remain available;
-
Technical defects will always be corrected immediately;

The Services will be compatible with every device or browser; or
-
General website content will meet every individual requirement.
This website disclaimer does not eliminate product obligations, express representations, statutory warranties, consumer guarantees, or other rights that cannot lawfully be excluded.
23. Limitation of liability
To the maximum extent permitted by applicable law, Éclat Living and its owners, officers, employees, agents, affiliates, service providers, suppliers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the Services.
Where permitted by law, our total liability for a claim relating to a specific order or product will not exceed the amount you paid for the affected order or product.
These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from:

Fraud or fraudulent misrepresentation;

Willful misconduct;

Gross negligence where it cannot be limited;

Death or personal injury caused by negligence where applicable;

24. Indemnification
To the extent permitted by law, you agree to reimburse Éclat Living for reasonable losses, liabilities, damages, and expenses arising directly from:

Your unlawful or fraudulent use of the Services;

Your material violation of these Terms;

Customer Content that infringes a third party’s rights; or
-
Your intentional interference with the security or operation of the Services.
This obligation does not apply to losses caused by Éclat Living’s own negligence, unlawful conduct, breach of these Terms, or failure to fulfill a legal obligation.
Nothing in this section requires a consumer to indemnify us in circumstances where doing so would be unlawful or unfair.
25. Force majeure
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fires, floods, epidemics, pandemics, war, terrorism, civil unrest, government action, sanctions, labor disputes, transportation disruptions, carrier failures, utility outages, internet failures, cyberattacks, or supplier interruptions.
We will make reasonable efforts to reduce the effect of such circumstances and communicate material delays when practicable.
This section does not remove any cancellation, refund, or other right that applicable law provides when an order cannot be fulfilled.
26. Suspension and termination
We may suspend or terminate your access to the Services when reasonably necessary because of:

A material violation of these Terms;

Fraudulent, unlawful, abusive, or harmful conduct;

A security threat;
-
Unauthorized use of an account or payment method;

Legal or regulatory requirements; or

Termination does not affect rights and obligations arising before termination, including payment obligations, accepted orders, intellectual-property rights, and provisions intended to survive termination.
27. Electronic communications
You agree that agreements, disclosures, notices, order confirmations, receipts, and other communications may be provided electronically, subject to applicable law.
Electronic communications satisfy legal requirements that communications be in writing when legally permitted.
You are responsible for maintaining an accurate email address and reviewing communications associated with your orders or account.
28. Governing law and disputes
Before beginning formal legal proceedings, you and Éclat Living agree to make a reasonable good-faith effort to resolve the matter by contacting the other party and providing relevant information.
These Terms and disputes arising from them are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles.
Subject to any mandatory consumer rights concerning jurisdiction, legal proceedings relating to these Terms may be brought in the state or federal courts located in United States and Florida, and each party consents to the jurisdiction of those courts.
Nothing in this section deprives a consumer of:

A mandatory protection provided by the law of the consumer’s place of residence;

The right to bring a claim in a court or forum that applicable law requires to remain available; or
-
The right to use a government, regulatory, or consumer-protection complaint procedure.
These Terms do not require binding arbitration and do not waive participation in a class or representative action.
29. Severability
If a court or other authorized body determines that a provision of these Terms is invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or modified only as necessary.
The remaining provisions will continue in effect.
30. No waiver
A delay or failure by Éclat Living to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
A waiver is effective only if it is provided in writing by an authorized representative.
31. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent.
We may assign these Terms as part of a merger, acquisition, reorganization, financing, sale of assets, change of control, or transfer of the business, subject to applicable law.
Any assignment will not reduce mandatory consumer rights or relieve the new operator of obligations relating to accepted orders.
32. Entire agreement
These Terms, together with the policies and disclosures expressly incorporated into them, constitute the entire agreement between you and Éclat Living concerning use of the Services.
If a product page, promotion, written warranty, or order-specific agreement contains terms that directly conflict with these Terms, the more specific terms will control for that product, promotion, warranty, or order to the extent permitted by law.
Headings are provided for convenience and do not affect interpretation.
